Instructions for Dismissal based on Good Driving Record
Instead of appearing in court on the date and time scheduled on your summons, you may request that the court dismiss your summons in accordance with G.L. 1956 § 31-41.1-7 (good driving statute) through this portal. Section 31-41.1-7 allows for the dismissal of certain motor vehicle violations if the motorist has had an active license and has received no moving violations within the past three (3) years.
The following violations shall not be dismissed pursuant to this statute:
  (1) Any violation within the original jurisdiction of the Superior or District Courts;
  (2) A refusal to submit to a chemical test of breath, blood, or urine pursuant to G.L. 1956 § 31-27-2.1;
  (3) Any violation involving a school bus;
  (4) Any violation involving an accident where there has been property damage or personal injury;
  (5) Any speeding violation more than fourteen miles per hour (14 m.p.h.) above the posted speed limit;
  (6) Any violation involving child restraints in motor vehicles pursuant to G.L. 1956 § 31-22-22; and
  (7) Any violation committed by a holder of a commercial license as defined in G.L. 1956 § 31-10.3-3
       or any violation committed in a commercial motor vehicle as defined in G.L. 1956 § 31-10.3-3 by
       an operator who does not hold a commercial license.
If you possess a valid current driver’s license from the State of Rhode Island, you need to submit your request through this portal, but you do not need to submit a copy of your driver’s abstract. However, if you are licensed by another state, the court must receive a certified copy of your driver’s abstract (your driving record) from your licensing state’s registry or department of motor vehicles. The court will not accept a copy of your driver’s abstract from a third-party provider, such as an insurance company or other online service.
If the court does not receive a copy of your driver’s abstract by the court date listed on your summons, or if you discover that you do not qualify for a dismissal, you must appear on your court date. If you do not appear, the court can enter a judgment by default. This means that the court can order you to pay the money owed without you being there.
If after reviewing your driver’s abstract the court decides that you do qualify for dismissal, the mandatory court costs are $63.25. There is a service fee for processing payment(s) online. The total charge amount will be displayed prior to submitting the payment.
Instructions for Submitting Proof of Corrective Action
Submitting proof or evidence of a corrective action means that you admit to the violation, but you wish to submit evidence to reduce or lower the fine or present proof that you corrected the violation.
If your traffic violation qualifies for submitting proof of a corrective action, you may submit the evidence or documentation through this portal. You will need to upload the proper document and provide an explanation of the document to the court.
